Lady Justice Grace Nzioka, in her ruling, determined that Joseph ‘Jowie’ Irungu knew murder victim Monica Kimani. And that the assertion in his defense that Jowie did not know Monica Kimani before her murder as ‘untenable, insincere, an afterthought, and false.’ The evidence revealed Jowie and the deceased were acquainted from being in the same class at Kenya Polytechnic.

“Court finds that the first accused person was known to the deceased because they were together at Kenya Polytechnic. They were in the same class,”

She said.

This is an interesting development as the nation awaits with bated breath for the Court to deliver a verdict in the 2018 murder case of Monica Kimani. Joseph ‘Jowie’ Irungu is the first defendant and Jacque Maribe is the second defendant. Initially, the ruling was set for March 15, but the date was pushed forward to February 9 after all the counsels in the case acquiesced.

Monica Kimani’s Death a Homicide

Additionally, Lady Justice Grace Nzioka ruled that Monica Kimani’s death was a homicide. And not an accidental or natural death. The court found the prosecution had proven the death was unlawful.

“Monica Kimani did not die of an accidental or natural cause. therefore, this is a clear case of homicide. The finding of this court is that the prosecution has proved that the death was unlawful.”

The judge stated that the blood from the nostrils of the victim resulted from a slit throat at the thyroid glands. And that the wound was inflicted while the victim was alive. Additionally, there was no evidence of strangulation or a bullet wound.

“There was no evidence of strangulation, nor a bullet wound, and there was nothing unusual in the pancreas indicating that the blood that was oozing from the nostrils was because the throat was slit at the level of the thyroid glands and clarified that the wound was not inflicted after death.”

She said.
