Embakasi East MP, Babu Owino, was today acquitted of misuse of a firearm in the shooting of DJ Evolve.
Milimani’s senior principal magistrate, Bernard Ochoi, said that the prosecution has not proven its case against the MP.
In his testimony, DJ Evolve told Justice Ochoi that he did not witness MP, Babu Owino, wielding a firearm in the club on the day he was shot.
And noted that he had a long-standing friendship with the MP of over five years.
Ochoi noted that the Investigating Officer’s reliance on CCTV footage was evident. “The footage,” the Magistrate stated, “cannot replace medical evidence. A medical report or P3 form should have been provided to establish that the victim sustained a gunshot wound.”
Upon reviewing the played CCTV footage, the court observed a clear counter where Babu stood, despite the dark background.
In acquitting Babu, the court highlighted that the ballistic report lacked definitive proof that Babu’s firearms were employed in the incident.
Babu Owino’s personal assistant, Edwin Otieno, on his part, testified that the gun the MP was carrying on that day was not functional.
“The gun had jammed two days earlier when [Babu] Owino was at a shooting range in Karen,” said Otieno, who also doubles as the MP’s bodyguard.
